1. Acceptance of Terms
By accessing or using SOOPER (“the Service”, “the Platform”, “we”, “us”, or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Service.
SOOPER is an AI-powered educational platform designed to help Canadian family medicine residents and International Medical Graduates (IMGs) prepare for the Simulated Office Orals (SOOs) portion of the College of Family Physicians of Canada (CCFP) certification examination.
2. Educational Purpose and Disclaimers
2.1 Educational Tool Only
SOOPER is a study aid and practice tool. It is not affiliated with, endorsed by, or officially connected to the College of Family Physicians of Canada (CFPC), the Medical Council of Canada (MCC), or any provincial medical regulatory authority. The practice cases, evaluations, and feedback provided through the Service are for educational and preparatory purposes only.
2.2 No Guarantee of Exam Success
While SOOPER is designed to help users prepare for the SOOs examination, we make no representations or warranties regarding your likelihood of passing the actual examination. Individual results will vary based on numerous factors including but not limited to: prior knowledge, study habits, clinical experience, and examination-day performance.
2.3 AI-Generated Content
The Service utilizes artificial intelligence technology to generate simulated patient interactions and provide evaluations. While we strive for accuracy and clinical relevance, AI-generated content may contain errors, inconsistencies, or may not perfectly reflect real-world clinical scenarios or official examination standards. Users should exercise professional judgment and supplement their preparation with other study resources.
3. Eligibility and Account Registration
3.1 Eligibility Requirements
To use SOOPER, you must:
- Be at least 18 years of age
- Be a medical student, resident, or licensed physician, or be enrolled in a medical education program
- Have the legal capacity to enter into binding contracts
- Reside in a jurisdiction where use of the Service is legal
3.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access or security breach
- Ensuring your account information is accurate and up to date
3.3 Account Sharing Prohibited
Each account is for individual use only. Sharing account credentials or access with others is strictly prohibited and may result in immediate account termination without refund.
4. Payment Terms and Stripe Integration
4.1 Payment Processing
All payments are processed securely through Stripe, Inc. (“Stripe”), a third-party payment processor. By making a payment, you agree to Stripe's Terms of Service and Privacy Policy. We do not directly store or process your payment card information.
4.2 Pricing Model
SOOPER offers the following pricing options:
- Free Tier: Access to one (1) practice case at no cost
- Paid Packages: One-time purchase options for 10 or 20 practice cases (pricing available at checkout)
Pricing and available packages are subject to change. Current pricing will always be displayed before purchase.
4.3 Pricing and Fees
Pricing information is displayed on our platform before purchase. All prices are in Canadian Dollars (CAD) unless otherwise stated. We reserve the right to modify pricing at any time, but changes will not affect active subscriptions until renewal.
4.4 Taxes
Prices displayed may not include applicable taxes such as GST/HST. Any required taxes will be calculated and added at checkout based on your billing location.
4.5 Billing and Automatic Renewal
If you purchase a subscription:
- Your subscription will automatically renew at the end of each billing cycle unless cancelled
- You will be charged using your selected payment method on file
- You will receive email notification prior to each renewal
- You may cancel automatic renewal at any time through your account settings
4.6 Payment Failures
If a payment fails, we will attempt to process it again. If payment continues to fail, your access to paid features may be suspended until payment is successfully processed. You remain responsible for any unpaid amounts.
5. Refund and Cancellation Policy
5.1 Cancellation Rights
You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period, and you will retain access to paid features until that time.
5.2 Refund Policy
We offer a full refund within seven (7) days of purchase. To request a refund within this period, contact us at support@sooper.ca with your account details. Refund requests will be processed within 5-7 business days.
After the 7-day refund period, all sales are final. Exceptions may be made on a case-by-case basis only if you were charged in error or experienced technical issues that prevented use of the Service and we were unable to resolve them.
5.3 No Partial Refunds
We do not provide prorated refunds for partial billing periods. If you cancel mid-cycle, you will retain access until the end of the paid period but will not receive a refund for the unused portion.
6. Acceptable Use Policy
You agree not to:
- Use the Service for any illegal purpose or in violation of any laws
- Share, distribute, or resell access to the Service or any content obtained through it
- Attempt to reverse engineer, decompile, or extract source code from the Service
- Use automated systems (bots, scrapers) to access the Service without permission
- Interfere with or disrupt the Service or servers hosting the Service
- Upload or transmit viruses, malware, or other malicious code
- Impersonate any person or entity, or falsely state or misrepresent your affiliation
- Collect or harvest personal information about other users
- Use the Service to provide professional medical advice or diagnosis to patients
- Record, copy, or redistribute AI-generated content without permission
7. Intellectual Property Rights
7.1 Our Content
All content on the Service, including but not limited to text, graphics, logos, images, audio clips, simulated patient cases, marking schemes, software, and AI-generated content, is the property of SOOPER or its content suppliers and is protected by Canadian and international intellectual property laws.
7.2 Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial educational purposes. This license does not include any right to:
- Resell or make commercial use of the Service or its content
- Download (other than page caching) or copy content for use outside the Service
- Use the Service or content for any public display or performance
- Modify or create derivative works based on the Service or content
7.3 Your Content
You retain ownership of any content you create or upload to the Service (“User Content”), such as session notes. However, by uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process your User Content solely for the purpose of providing and improving the Service.
7.4 Feedback
If you provide feedback, suggestions, or ideas about the Service, you grant us the right to use such feedback without compensation or attribution, for any purpose including improving the Service or developing new features.
8. Data Collection and Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection, use, and disclosure of your information as described in our Privacy Policy.

- Session transcripts and performance data are stored for evaluation purposes
- We use third-party services (Firebase, Stripe, ElevenLabs, Anthropic) which have their own privacy policies

9. Third-Party Services
The Service integrates with various third-party services, including but not limited to:
- Firebase (Google): Authentication and database services
- Stripe: Payment processing
- ElevenLabs: Conversational AI technology
- Anthropic: AI evaluation and assessment
Your use of these third-party services through our platform may be subject to their respective terms of service and privacy policies. We are not responsible for the practices or performance of these third-party services.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
- Warranties regarding the accuracy, reliability, or completeness of content
- Warranties that the Service will be uninterrupted, secure, or error-free
- Warranties that defects will be corrected
- Warranties regarding exam preparation effectiveness or outcomes
No advice or information obtained through the Service creates any warranty not expressly stated in these Terms.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOOPER AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total liability to you for any claims arising from or related to these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months immediately preceding the claim, or CAD $100, whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you.
12. Indemnification
You agree to indemnify, defend, and hold harmless SOOPER and its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney fees) arising from or related to:
- Your use or misuse of the Service
- Your violation of these Terms
- Your violation of any third-party rights, including intellectual property rights
- Your User Content
- Any breach of your representations and warranties
13. Termination
13.1 Termination by You
You may terminate your account at any time by contacting us or using the account deletion feature in your settings.
13.2 Termination by Us
We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including but not limited to:
- Violation of these Terms
- Fraudulent, abusive, or illegal activity
- Extended periods of inactivity
- Technical or security reasons
- Requests by law enforcement or regulatory agencies
13.3 Effect of Termination
Upon termination, your right to use the Service will immediately cease. We may delete your account and any associated data, though we may retain certain information as required by law or for legitimate business purposes. Provisions of these Terms that by their nature should survive termination will survive, including intellectual property provisions, disclaimers, limitations of liability, and dispute resolution provisions.
14. Dispute Resolution and Governing Law
14.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Alberta, Canada, without regard to its conflict of law provisions.
14.2 Informal Resolution
Before filing a formal dispute, you agree to contact us at support@sooper.ca to attempt to resolve the issue informally. We will attempt to resolve disputes in good faith within 30 days.
14.3 Jurisdiction
Any legal action or proceeding arising from or related to these Terms or the Service shall be brought exclusively in the courts located in Calgary, Alberta, Canada. You consent to the personal jurisdiction of these courts and waive any objection to venue.
15. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by:
- Posting the updated Terms on the Service with a new “Last Updated” date
- Sending email notification to registered users
- Displaying a prominent notice on the Service
Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service and cancel your account.
16. General Provisions
16.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and SOOPER regarding the Service and supersede all prior agreements and understandings.
16.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
16.3 Waiver
Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
16.4 Assignment
You may not assign or transfer these Terms or your account without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
16.5 Force Majeure
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
